THIS AGREEMENT, made and entered into this 15th day March by and between the Village of Melvin a Municipal Corporation of Ford County, Illinois hereinafter for the convenience referred to as “Village” and Arlan Kaufmann, d/b/a Kaufmann, Disposal Service, hereinafter for convenience called “Contractor”


WHEREAS: the Village has negotiated with Contractor for the collection and disposal of garbage and refuse within the village limits of the Village of Melvin.

Now therefore, it is mutually covenanted and agreed by and between the Village and Contractor as follows:

1. That commencing April 1, 2017 Contractor shall pick up and dispose of all garbage and refuse for the residents residing within the village limits of the village limits of the Village of Melvin and all commercial properties within the village limits of the village of Melvin, Illinois.

2. Contractor shall pick up and dispose of said refuse each Wednesday for three years beginning April 1, 2017.

3. Each resident and commercial user in the village using the contractor’s services pursuant to this contract will place his garbage cans or other watertight receptacles to permit convenient sanitary handling thereof. Each user will be expected and required to place his garbage and refuse in said receptacles and make them available at a convenient place for pick-up and emptying on the designated garbage pick-up day.

4. The Village agrees to pay $2,385.00 per month during the existence of this contract with said payment to be paid (sent) on the second Wednesday of the month succeeding the month in which the payment is being made.

5. If there are household furnishings, there will be a charge to the house residents separate from the garbage/refuse bill. Those items will not be picked up in conjunction with this contract.

6. The Contractor has the right to adjust the rate of contract on second and third years according to landfill increases.

7. For and in consideration of the foregoing payments, contractor agrees to provide good and satisfactory garbage/refuge disposal service to the residents of the Village of Melvin, including, but not limited to the utilization of satisfactory and sanitary motor vehicle equipment and the correction of all just and legitimate complaints by users.

8. The Village shall have the right to deduct from monthly payments to Contractor and appropriate amount for damages as determined by the Village board of Trustees, for any breach of this contract which has occurred during the month for which payment is sought.

9. Contractor shall maintain liability insurance with coverage in an amount of at least One Hundred Thousand Dollars ($100,000) per person and Three Hundred Thousand Dollars ($300,000) per incident and an umbrella liability policy of at least One Million Dollars ($1,000,000)

10. Contractor shall supply to the village a Certificate of Insurance verifying the aforesaid insurance coverage and shall instruct carrier to provide village with copy of any Notice of Cancellation of said coverage.

11. The Village shall have the right to terminate this contract for any breach but only upon written notice delivered to the Contractor of the breach for failure of contractor to cure breach with in seven (7) days of receipt of the notice. Delivery shall be conclusively deemed accomplished three (3) days after deposit of the written notice with the United States Postal Service in and envelope address to contractor at the address listed hereinafter, with postage properly prepaid.

12. This contract shall expire the 31st of March, 2020.

IN WITNESS WHEREOF, said Village of Melvin has caused these presents to be executed by its President and Attested by its Clerk, and the said Contractor has hereunto set his hand and seal the day and year first above and set forth.
